2. Refund Policy
2.1 General Policy
By retaining our services and signing our contract, you agree to a No-Refund Policy, unless otherwise stated in writing by our legal team.
2.2 No Refunds Will Be Issued For:
- Voluntary cancellation of services by the client
- Refusal of visa due to:
- Incomplete documents or failure to submit on time
- Criminal record or medical inadmissibility
- Misrepresentation or false declarations
- Ineligibility based on immigration criteria (e.g., language scores, work history)
- Changing immigration laws or quotas
2.3 Exceptional Refunds
In rare cases, refunds may be granted at the sole discretion of Afaq Al Hijra’s legal department. A formal written request must be submitted, and any refund approved will be processed within 90 business days.
3. Governing Law & Dispute Resolution
3.1 Applicable Law
This policy is governed by the laws of the Sultanate of Oman, including:
- Omani Consumer Protection Law (Royal Decree 34/2014)
- Omani Commercial Arbitration Law (Royal Decree 47/1997)
- Omani Personal Data Protection Law (Royal Decree 6/2024)
3.2 Dispute Resolution
- Any dispute shall first be resolved through arbitration in Muscat under the applicable Omani laws.
- If arbitration fails or is inapplicable, the competent courts of Muscat shall have exclusive jurisdiction.
